Isn't the # of >170 LSAT scores just a function of the total # of testtakers?

IIRC, 170+ just represents top 2%. If LSAT administrations drop 30%, the number of people in the top 2% will drop the same amount.

the test isn't curved

it is scaled

"scaling" is basically trying to curve a test while eliminating or minimizing the very artifact you describe.

so basically "170" represents roughly top 2%, but not as a hard and fast rule. if you flooded the test centers with retards next year you would not make the curve easier, that year would just have a non-normal looking distribution (if you plotted out the scaled scores)
