Say for instance a lawyer files a brief with a fake or misdescribed authority and then the opposing party doesn't catch it and the Judge or clerk relies on it. The court issues an opinion adopting the hallucination. Later courts cite that opinion. What's funny about this is noone would even have to cite the AI hallucination they just cite the real judge's opinion.

It's 100% going to happen. In my state, the judge usually asks the party that wins the motion to draft the order granting his motion. I highly doubt they check much of anything in the orders that are sent in.

It's interesting bc if the hallucination is just part of the argument and not the whole thing, we'll never know if it was Responsible for the judge's decision. Even the judge probably does not have precise enough access to their epistemic state at the time to say. So even if it's discovered later it probably won't be easy to overturn the original decision. And by then it's exploded to other cases anyway and become a part of Law.
