I played an interesting test on my wife. Our kids were watching Pokémon Detective or whatever and that actress Kathryn Newton was in it. I asked her how old that chick is. She said “she looks 15.”
I looked it up and I found out that chick is 28 turning 29 now. It was filmed in 2019 6 years ago so she’s 22 when it came out. A stretch would be 2 years of filming so 20 max.
My wife was shocked but it shows how people’s interpretations of age can be off.
Now let’s say you met an 18 year old real person
and took suggestive pictures of her. The ways the laws are written you’re good. You have proof someone is 18 no worries.
Let’s say you made an 18 year old AI character and made suggestive photos of her. AI photos and videos are held to the same standard as real photos. But here’s the catch. There’s no age of what an AI photos is-it’s what a reasonable person says it is.
So do you want to leave it up to a jury the reasonable age of an ai created character? Do you want to be the test subject for this bizarre area of the law?
