One of my clients on mental health diversion that did really well was an arsonist with schizophrenia facing a third strike (25 to life).
Most judges in our county would be hesitant to grant a mental health diversion motion when the diagnosis is “major depression” though. Harder to see a nexus between the mental illness and the commission of the crime for that one compared to something like schizophrenia where hearing voices/insane delusions are expected symptoms |
