To the Honorable Court,
Defendant moves to dismiss the complaint of the plaintiff for failure to state a claim under Rule 12(b)(6) of the Federal Rules of Civil Procedure.
The plaintiff's complaint fails to allege sufficient factual allegations to support the claim for relief sought. Without such allegations, the defendant is unable to respond to the allegations in the complaint, and the court should therefore dismiss the complaint for failure to state a claim.
Furthermore, the plaintiff's complaint does not provide any legal basis for the claim alleged. Without a legal basis for the claim, the plaintiff's complaint fails to provide the defendant with notice of the claim and the grounds upon which it rests, as required by Rule 8(a) of the Federal Rules of Civil Procedure.
For these reasons, defendant respectfully requests that the court grant this motion to dismiss for failure to state a claim under Rule 12(b)(6).
