Con law is kind of retarded. The practical effect of this is that a district court just needs to show a paper record that it considered this and determined that the behavior in question was or was not within the scope of duties. Then appellate courts will build out whole balancing tests that amount to eyeballing it. Some circuits will say that anything against the law can’t be an official act. SCOTUS will tell them to try again because immunity must have meaning (even though they created it). Ultimately no one will really know and it will come down to whether the behavior is “bad” enough
