I am really, really sorry about this, but I have been as flexible and forgiving as a person can be expected to be, and I haven't heard from you in over a month now.

Throughout last year, despite being told that I had "free license", I was more than communicative with regard to costs, getting approval before purchasing more expensive plant material, etc.

To-date you've paid a total of $4000 of a total of $9640.64 owed for landscape improvement services, Fence repair/painting, vegetable garden improvements, powerwashing, and landscape/garden maintenance.

If the remaining $5640.64 is not paid in full in 30 days (June 23, 2024), I'll be forced to file suit for the balance as well as interest accrued on the material purchased on credit.

Happy to send a digital invoice so you can pay by card.

If I do not receive a response to this email, I will send a hard copy via certified mail.

Thank you.

He basically did not invoice me all of last summer and then hits me with a $10k bill for a bunch of shit I agreed to but he's clearly milking. The itemization on his invoice reflects that he is milking it. We also have no contract or written agreement in place.

He also sent a follow-up e-mail to that invoice indicating "I was just going to email you to tell you not to pay that, I realized there are a few things I double charged you for". He never sent an updated invoice reflecting these double charges.

He built vegetable garden beds, replaced mulch, and other stuff I had no time to do last summer and wife was very pregnant so we needed help with the garden.

He also helped with power washing my house, guest house, garage and painting/sanding/washing a large wooden fence.

No contract stating scope of work. He sent a proposal which I never responded to and everything subsequent to that was communicated verbally. I did not provide him with "free license", verbally or otherwise, and asked him to send monthly invoices, which he did not.

if he performed under the proposal and you accepted his services under the proposal, and the proposal reflects the larger amount, you lose IMO.

It's going to be a fact issue. Proposal + silence/acceptance of benefits creates a strong estoppel argument, but the contract (if one existed) isn't subject to the statute of frauds so nothing precludes OP from introducing subsequent oral discussions/modifications.

The most realistic scenario is that whatever the fuck they discussed is void for indefiniteness/absence of key terms, and the gardner can recover in quantum meruit for the fair market value of his work (which isn't whatever the fuck the gardner says).

Why didn’t you respond to the proposal?

Did the proposal have a dollar amount on it and if so what was it?

Do you have your ignored requests for monthly invoices documented?

send him a check for $500 that says "for all outstanding invoices/work" in the memo line. if he cashes it you win. accord and satisfaction.

The distinguishing factor here for me is whether the "person" he defrauded is a person in the human sense or the corporate sense. If he fucked over a small business, he's a piece of shit. If he's just being shrewd with a large contracting firm, then hey, that's the cost of doing business! That's what insurance is for!

I would def just do a Sam Hyde here and say "come kill me" and let him try to figure out the fact that he can try to get a lawyer, or small claims you, or whatever, but good luck ever collecting.

Get on a payment plan with some debt collector and then keep readjusting it and never actually pay more than like $5 while your gardener gets to stress over it.
