It ended up getting shut down because some Hawaii judge said that was discriminatory. I wonder if Uber gets away with it because it allows men on its platform. But it will be interesting. My understanding is that the reason that male drivers earn more is because the best time to drive for Uber is when the bars close, and female drivers don't want to let a bunch of drunk randos into their cars. If female drivers suddenly start earning significantly more than their male counterparts once this change goes into effect, the male drivers might have a case. And when you consider the fact that female Uber drivers earn significantly less than male drivers and most of that is explained by the fact that they are scared to let random drunk guys into their cars when the bars close, I think there is a good chance that this type of policy would survive intermediate scrutiny.
