I am really, really sorry about this, but I have been as flexible and forgiving as a person can be expected to be, and I haven't heard from you in over a month now.

Throughout last year, despite being told that I had "free license", I was more than communicative with regard to costs, getting approval before purchasing more expensive plant material, etc.

To-date you've paid a total of $4000 of a total of $9640.64 owed for landscape improvement services, Fence repair/painting, vegetable garden improvements, powerwashing, and landscape/garden maintenance.

If the remaining $5640.64 is not paid in full in 30 days (June 23, 2024), I'll be forced to file suit for the balance as well as interest accrued on the material purchased on credit.

Happy to send a digital invoice so you can pay by card.

If I do not receive a response to this email, I will send a hard copy via certified mail.

He basically did not invoice me all of last summer and then hits me with a $10k bill for a bunch of shit I agreed to but he's clearly milking. The itemization on his invoice reflects that he is milking it. We also have no contract or written agreement in place.

He also sent a follow-up e-mail to that invoice indicating "I was just going to email you to tell you not to pay that, I realized there are a few things I double charged you for". He never sent an updated invoice reflecting these double charges.

He also helped with power washing my house, guest house, garage and painting/sanding/washing a large wooden fence.

It's going to be a fact issue. Proposal + silence/acceptance of benefits creates a strong estoppel argument, but the contract (if one existed) isn't subject to the statute of frauds so nothing precludes OP from introducing subsequent oral discussions/modifications.

The most realistic scenario is that whatever the fuck they discussed is void for indefiniteness/absence of key terms, and the gardner can recover in quantum meruit for the fair market value of his work (which isn't whatever the fuck the gardner says).
