The Court held that it's unlikely that the Jan 6 tweets or public addresses would be outside the cover of immunity. They held that Trump's pressuring of Pence is entitled to "presumptive immunity"! The Court treated Trump's claim of immunity for the GA SoS communications on even ground with the gov't's argument of no immunity.
A fair reading of this opinion by a district court judge would pretty much chop most of the indictment's allegations out. Some conservative judges could even feel like they have a colorable basis to toss it entirely. |
