Never get to taste the sweet victories of litigation. Nothing better in law than after months of heated arguments with opposing counsel to get fully and completely vindicated by the court. Nothing.

discovery dispute. heated meet and confer phone calls where we basically called each other assholes. they filed an ex parte motion to strike on like every fucking paper we filed to get these documents, including to our moving papers and to our reply papers, and requested sanctions at least 4 times on one motion. it was a huge clusterfuck of ex parte motions. judge awarded us sanctions in the amount of $20k and ordered documents produced. YNY.

If you can't enjoy shit like this you definitely shouldn't be in law, it is the only part of my job that is enjoyable, knowing that at the end of the day someone will tell me whether I "won" or not. It's the closest thing to sports in the normal job world.

The phrase "discovery dispute" is one of the best signals you're talking to a shitty lawyer. And, most likely, a 2nd to 4th year associate who spends 85% of their time in "discovery disputes" to rack up billables, and therefore has he mistaken impression that this shit is actually difficult or important.

Depends I guess. Generally if you are sanctioned you were being objectively unreasonable, which usually means you just wasted a bunch of the client's money arguing something that wasn't really an issue. So not only did the client have to pay a boatload for you to file all that shit, but it wasn't even about something that you had a remote chance of winning, and on top of that have to pay some of the other sides attorneys' fees.

Sanctions in discovery for anything short of wholesale failure to produce in violation of something "so ordered" are unheard of. 20k for one frivolous motion even more so. That stinks of flame. If conduct is that frivolous the judge will sooner strike pleadings and trigger a malpractice action against you. Kills two birds with one stone - you and your shitty case.

you are on the right path bro. we took position something was previously ordered they took position it wasn't within scope of order. and like i said it wasn't really one motion because they filed fucking 2 ex parte motions to counter our motion -- to strike our moving papers and to strike our reply papers, not to mention their opposition papers. it caused a huge headache for the court and racked up a ton of attorneys' fees on our side.

I've done some small transactional shit -- like shareholder agreements for smallish companies; franchise agreements; and some employment shit like severance agreements. The day to day was generally more enjoyable because it's more social and you are on the phone talking to people to find out what's important. There was also generally less anxiety because at the end of the day I knew there was no opposing counsel or judge to keep me honest -- I mean who the fuck really knows whether that provision is enforceable (and who cares?), no one is going to draft some extensive brief calling you out on it.

But at the end of the day it just feels meh. I didn't feel like I was creating a business just because I drafted the shareholder agreement. But I do feel like I won that discovery dispute.

Getting off on a discovery dispute win is lame as shit.

The fact is more "litigation" involves mind dead work as does corporate shit.

No one "wins" in litigation. Overly 90% of cases settle in my practice areas so LOL at you enjoying your triumphent mediation "victory" where you split the difference.

It's really good in comparison to the alternatives in law.

You do important work and the workload is very manageable (though it's far from a joke job like a lot of federal positions).

As a federal worker, though, we haven't seen a COLA raise in 3 years or so and there is none on the horizon. I make about 110k in ARE country. Certainly can't complain.
