1) even assuming Cohen is telling the truth, he'd likely be considered a public figure under the case law, in which case he'd have a very difficult burden of proving intentional malice (basically .0001% chance of winning).
2) whether Cohen is telling the truth or not, the litigation will require discovery into his activities with the Trump campaign and he doesn't want that information disclosed (embarrassing info or maybe evidence that will bolster prosecution's case).
3) Cohen might not be telling the truth.
The lawsuit was always a stupid publicity stunt. He never had a chance.
