First, on Thursday the defense made a bunch of motions to keep out the video of our expert. Most importantly, the video of him giving costs of future surgery. They argued since the surgery was conditioned on a positive discogram that it may not be needed. Chandler argued and won that issue. The entire video of our expert came in. On that point we presented our expert via video. Basically we just taped the defenses depo of our expert and joined the notice. This saved us 12k in costs since we didnt have to call our expert.

Today we played the video. Everything came in. Our expert cut our doctors costs a bit but that made us seem reasonable. Then defense called their doctor. Chandler got him to admit that the risk of epidurals is paralysis and death (which he later used on closing ti argue no plaintiff would commit fraud with those risks). Defense pulled some crazy shit though where they found 2 pages that looked like an incomplete PI report template that looked shady. Made the treating doctor look bad at first.

Chandler then asked the defense doctor if there were any other ossues in the 2,000 pages of records. The doctor said no.

Then Chandler and defense did their closings. Chandler argued that 2 page template was just a report draft and a red herring. He asked for nearly 500k per person. He said he got good eye contact from the female jurors but one fat slob juror wouldnt make eye contact. Chandler hammered that their doctor billed 27k for testomy and how ridiculous that was. He said we saved pur clients moneh and days of the jury's time by calling via video. That really resonated woth them he thinks.

Defense argued this was all fraud between the doctors and clients. They asked for a defense verdict and in the alternative 10k each.

Judge read the jury instructions and they started deliberating at 330. The recessed at 415. Back to deliberations tomorrow.

Was this a treating doc? If so, why was he drafting a report as a non-retained expert?

Edit: just re-read the description. Sounds like it may have been worth it to spend the $15k to get the doctor to appear for live testimony. On the other hand, sunk cost fallacy and all of that.
