So others who have suffered losses will come forward and try to explain why they and their lawyers should be in charge of the case. They whoever is appointed will file an amended complaint that will have more detail. They may try to get some confidential witnesses to bolster the allegations in the complaint. There is then a 50/50 shot or so of getting this case tossed on a motion to dismiss. It is lower in Massachusetts than it would be in the SDNY. If the case survives dismissal, plaintiffs will settle for anywhere from 2-30% of their total alleged damages, and the lawyers will keep 30% of that. It is a volume game for plaintiffs lawyers, though they always get money if they get past a MTD and every few years they will settle a case for $80MM plus.
