Don't you think that someone in the position of such privilege should come to that kind of a learning session with two open ears rather than an open and obnoxious mouth? It's not like the session was meant to brainstorm better effective research techniques for this new topic. It was to introduce newbies unfamiliar with the topic to open their minds to it.
Medical students need as part of their training to be exposed to the obstacles that their patients face in society, and they are not typically tuned into them because their lives have been about books and competition with their mostly white classmates. This guy should have been more humble in that session and taken the time to listen. And he got his hat handed to him. Have a hard time sympathizing. |

2) Of course his questions were good ones, and of course microaggression is bullshit, but he missed the higher point, in ASPIE fashion. There are some bullshit things you are just supposed to put up w, because it's good for you professionally. Are you going to harass a patient who claims to be a Covid Long-Hauler when it's all psychosomatic? Not a good way to practice medicine. It is a good way to piss people off and have yourself sued.
3) He's not a doctor yet. When he's a doctor he can submit whatever crap he wants to the most stringent review. As a STUDENT in medical school, part of his job is to show he can go along to get along, at least reasonably well to be employable.
My thoughts. I'm sure xo aspies will tell me he should call bullshit out whenever he's "Tortured by having to listen to it" or whatever, but that's not how professional training in the med school scenario works. |

Importantly though, the hearing is about behaviours reported after the seminar; the hearing is not because of his actions at the seminar.

The law in this area is AWFUL; they have to not only have a total kangaroo-court *procedure*, but they essentially have to have inappropriately intervened in that specific instance to subvert the procedure against the accused. My case involved a 3-member panel voting 2-1 in favor of the prof, then the dean *punishing* one of the not-responsible votes for comments made in the hearing (*literally*, I'm not exaggerating, think something along the lines of "I just don't understand why [complainant] would continue to talk constantly to [professor] on social media every single day for a month if [non-physical but allegedly harassing conduct had really happened]"), and then reconvening the hearing with a new hand-picked panelist from a non-academic station (think Shoshanna Goldstein from the Student Affairs Office of Diversity and Inclusion), who flipped the vote 2-1 against the prof. (N.B.: Profs at least still have some right to have their colleagues involved in the liability phase of their disciplinary hearing, but the penalty phase -- and typically now all phases for students (and I do *those* cases for rich kids regularly) -- are managed by these Student Affairs-type offices. Academic profs may be worthless shitlibs, but they are still way, way better than the type of person who today is responsible for (e.g.) garden-variety Title IX proceedings.)
Add on that you're working purely for fees -- since the damages claim *WILL* get tossed on QI, guaranteed, so you're getting injunctive relief if anything -- and every good lawyer has better ways to invest their time. |

I think in an odd way, the internet has magnified the importance or apparent importance (and I really don't know which one is more accurate to say or focus on) of the ideological viewpoints of these top media outlets, institutions, and POVs, by -- in keeping with the NPC meme -- giving everyone in the 'aspiring elite' crowd a loud and pervasive drum to march in time to. I say its odd because the most obvious impact on at least the news media (who I consider to be the main culprit in all of this) has been negative: their content can be shared/stolen instantly, the barriers to entry for new competition is like nothing, and the advertising-based model that worked well for newspapers and TV just doesn't pay well online, creating a well-known financial crisis for the industry. Even putting aside the financial situation and looking at the more abstract matter of the media/institutions serving as cultural/political tastemakers-cum-politruks, you would *think* that their power would be diminished by the availability of alternative, including conservative, ecosystems (online forums, news outlets, etc.).
What I guess I failed to foresee is the impressively strong coherence of the UMC / bourgeoise / aspiring elite (I'm failing to fully capture the group I'm talking about, and some components of the group I'm talking about will be stronger / more fanatical than others, but you get the point). |

Maybe UVA has to be sued by naming its POTUS, but William & Mary has to be sued by naming its Board of Governors as an entity (don't name them as individuals, since they don't have any individual power to carry out the injunction!).
All 1983 damages claims are subject to either QI (when the claim is against an individual) or Monell (when its against a municipality or some other organization/government-level entity). QI theoretically just requires that the right violated be "clearly established," but in reality it requires that the exact *violation* committed have been clearly established to be a constitutional violation -- typically by a past in-Circuit appellate-level case -- at the time of the violation. This is rare in non-excessive-force cases, and becoming rarer even with those; it also devolves, in practice, into a comical game of "DISTINGUISH THAT CASE" where the defense argues that the instant case is not clearly established by the 2003 11th Circuit case of Mandingo v. Officer Billy Bob, because in this case, the officer shot the plaintiff in the head after mistaking him for a wanted fugitive but it was after sundown and almost dark outside, whereas in Mandingo the officer shot the misidentified plaintiff in broad daylight. ("Also, the shooting in Mandingo occurred on a mere Tuesday, whereas the shooting here occurred on a Thursday -- known to be a higher-crime day of the week when police must be at their most vigilant.") Monell requires establishing a pattern, practice, or custom of similar (read: identical) deprivations, and as a matter of causation, you can only make out a Monell claim if you already succeeded on your individual claim -- since a pattern of unconstitutional conduct that didn't harm your client isn't cognizable.
EDIT: Note that in the Mandingo case, although the Court did find that the officer violated Mr. Mandingo's right to be free from being suspicionlessly shot in the back of the head, it was not at that point clearly established, so QI applied and the case was dismissed. *Future* defendants, however, are now on notice, at least in the 11th Circuit. |
