1. Shia Islam: The Authority of the Living Jurist
In Twelver Shia Islam (the dominant sect in Iran), religious law is not static, but it is not arbitrary.
Mechanism of Change (Ijtihad): Shia theology places a heavy emphasis on Ijtihad (independent reasoning). Qualified scholars (Mujtahids) are encouraged to analyze the Quran and Hadith to derive rulings for modern circumstances.
The Role of the Ruler: Historically, Shia Islam teaches that there is no legitimate Islamic ruler until the return of the 12th Imam (the Mahdi). Therefore, for most of history, Shias did not have a "caliph" or "monarch" to defer to. Instead, they followed the leading religious scholars.
