candy ride filed a shitty brief, court rejected it for being shit so he had to file another, but it was still shit. at oral argument he spends the entire time arguing about his shitty lawyering, never even getting to the merits of the case.
against the hot bench grilling him on his god awful lawyering (something candy ride/zzz has a lot of experience with), candy ride/zzz repeatedly "respectfully" accuses the court of splitting hairs and not being fair. |

all he had to fucking do is say "sorry judge i meant that's 1 example of the 10 of the apples, i'll get you the other 9 tomorrow." the judge *EXPLICITLY* guides him to this by hand by asking if he should have used different words.
candy ride is just dug in and pissed at the trial courts. he's doing the same say he does here, just being obstinate and refusing to just admit to a fairly tiny mistake. instead of simply saying "whoops haha we fucked up an exhibit my bad haha happens a lot with me lol i'm pretty dumb" he repeats over and over again that the judge is being "nitpicky." even if the judge was (he wasn't), you don't say that. if a judge asks a stupid question you do your best to answer it. you can't just say "lol ur honor that's dumb moving on..." which is what candy ride did, and that's why the judge is fucking pissed at him. |

later, he amended his complaint adding all sorts of allegations. some of these allegations defeated the conversion claim or were contradictory with each other. this would be fine if he laid out each cause of action, but for some reason he didn't. i suspect either because he wanted to continue to avail himself of the form complaint benefits or because he's just terrible.
this is literally vexatious litigation that he employed against epah and discover. to play devil's advocate in favor of candy ride and make in argument he's being strategic: it's that he wants to amend the complaint over and over so that the defense has to keep filing motions to dismiss and eventually just settles. that's why there's an abuse exception to being able to amend your pleadings endlessly. |

this should be simple. especially when when the defense *fucking concedes* that there are enough facts to alleged to sustain a conversion claim. she's basically saying "yeah the complaint shouldn't be dismissed except that they're abusing the process." all candy ride had to do was prove to the judges that *this* time he'll actually file the complaint properly. but he did the exact opposite, not only by completely missing the point of the judges questions, but by being obstinate and demonstrating no indication he'd learned from his mistakes.
that's also why it's so ridiculous he keeps repeating "they took our stuff. they should give it back." that doesn't fucking matter. he's wasting his time. and it's insulting to the judges. they know how fucking conversion works. they don't need it explained once, let alone 20x. watch epah's oral and how he just skips right past everything and gets to the heart of the matter. even the defense chick in this case doesn't sit around arguing whether the allegations are true. the judge even tells candy ride "they are alleged therefore those are the facts."
at this stage the court *HAS* to take the allegations as true. there's no strategic reason for candy ride to argue this over and over. he's acting like a pro se plaintiff. he doesn't even know why he's there. they have these forms so *ANYONE* off the street can file a complaint and not have it dismissed. you don't have to *PROVE* anything. i could go to your state and file a complaint saying "HATP STOLE MY DOG" and you couldn't have it dismissed, the case would proceed and *THEN* i'd have to present evidence. candy ride never got there.
consider that both cslg and epah, to polar opposites on the political and xo spectrum, have talked about how candy ride is dogshit. consider that the entire bort sided with epah when 90% of people here will kneejerk side against him if there is *any* reasonable way to do so. this isn't "grrr gunneratttt mad at candy ride." he is legitimately FUCKING TERRIBLE. |

He still should have properly pled all counts in the beginning instead of leaving off a bunch of counts while the SOL is presumably still running against those counts and risking a denial of second or third leave to amend. |

Don't like the judges claiming he's trying to prove something. Seems pedantic. I would probably have said "I'm not making an assertion here - I am pointing out the fact that the court chose not to provide any reasoning on the record, from which I ask the court to infer that no such reasoning was provided off the record".
Kind of moronic for him to blab about nitpicking, etc., complaining about the defendant's substantive conduct, and then provoking the judge into a long detour about whether he's nitpicking. Just say "certainly, your honor, and I understand how that inference might be drawn. Nonetheless, those four instances are sufficient to support a RICO claim, and, since the exhibit controls, our claim would satisfy the predicate act prong." Not that it matters that much, because the whole problem was lumping the defendants together.
His manner aside, he seems right and the actual dismissal seems to be the definition of 'splitting hairs', since fraudulent acts are properly alleged against each person in the general allegations. Especially given the RICO claims, I don't see why not file in federal court where he wouldn't have to deal with TTT state judges giving unreasoned orders. |
