She's apparently talking about Section 4(g)(3)(C) of the Presidential Transition Act of 1963, as amended (the "Act"). Section 4(g)(1) of the Act requires Biden to negotiate an MOU with the transition representative. Under Section 4(g)(3)(A) of the Act, that MOU must contain an ethics plan.
Section 4(g)(3)(C) of the Act requires the transition team to make the ethical plan publicly available on the earlier of the day the MOU is agreed and October 1.
This is weird, because October 1 is only in play if the MOU has not yet been negotiated, but the ethics plan is part of the MOU. I guess Warren's view is that the October 1 public posting deadline imposed a requirement on the transition team to agree an MOU by October 1, even though the statute otherwise tasks only the President with negotiating it (not the transition team with agreeing it). This is not obviously the right reading, though. |
