i think it's a justifiable shot given the circumstances. he was right to draw on him once he saw the gun, he lost sight of it, he didn't know it had been taken, he heard it go off, so he fired back. the whole situation is stupid of course, but legal i think. |

2 is a fair point, but his argument would be that he knows there's a gun and a struggle and one shot has already been fired, he doesn't have to wait until someone gets hit to use lethal force. |
