Date: November 21st, 2013 11:50 AM Author: Irradiated liquid oxygen knife -The DC Circuit, while important, has a very low caseload, and these three judges are not going to have a very significant impact, especially with a lot of senior Reagan-era nominees still staffing cases. -Maybe his goal is to staff the bench with 50- to 52-year-old judges who'll be shortlisted for the next Democratic administration for SCOTUS. But that's a very very long game and assumes that no one else in the wings is any good for a short list. -There's only a couple of years left in his term for him to even get nominees through, and he's nominated at a lower rate. So while I get that Obama and Reid have advantages to going nuclear, doesn't this, in the long run, likely fail a Rawlsian test in terms of long-term advantage? Anyone liberals want to defend on the basis of something I'm missing. tyia |

They should cut it to 9. But the GOP is stupid for saying "well it's so low so we should just leave it vacant."
