They will generally feel coerced into doing what the feds want regardless of how "polite" the "request" was, regardless of the intent, and regardless of whether the feds have any teeth in the matter.

In practice 99.99% of the time companies just do whatever the feds ask. The remaining 0.01% is only with F500 companies who have serious lobbying power, etc.

the fact that they deferred to the agency discouraged a ton of appeals. that's the real reason it was done - the courts realized they didn't have the ability to handle all that shit, so they deferred to the agency as long as the interpretation was reasonable, i.e. "don't bother appealing unless the agency interpretation is completely unreasonable." that deterrence is gone now. there are usually several reasonable interpretations of an ambiguous law and the courts just invited everyone to present them.

agree with the guy above that the agencies have to pull back here too because they nor DOJ have unlimited resources to fight all these appeals. they will probably shy away from taking actions based on any statute that isn't crystal clear. which sounds great, but we all know how common ambiguous laws are. the agencies are going to tell the white house we can't do x without clear authorization, the white house will try and get it passed, and congress will be completely fucking useless as always and nothing will get done. which is fine i guess if you don't like safe air travel, food and drugs, waste disposal, etc.

I really can't stand the people who bring up shit like safe air travel and salmonella in the lettuce as reasons for the Deep State to rule our lives. This is exactly like the unfunny lib parody in the NYT where they interviewed some low level regulators and said see this is the shadowy deep state the right is always complaining about!

No one wants unsafe air travel or e coli outbreaks. It's not about that. No one is saying the executive branch has no authority to regulate anything. That would be absurd. We just want some form of recourse if the EPA says no one can build houses here because some obscure butterfly species is threatened and therefore you must never access affordable property and live in a dilapidated hovel forever goy that you have some amount of recourse now. that SEC case might have fucked up my practice. i'm a traditional labor lawyer, and the NLRB prosecutes its own cases where employers are accused of unfair labor practices. i haven't read the decision yet, but i think their ALJs might be no more, and the agency is gonna have to file suit in district court to enforce the law, which it doesn't really have the resources to do, lol.

i was planning on doing this another 10 years, but that might be 5 at this point.

ALJs will still exist. in most cases you can't appeal until there is a final agency action and ALJs come before the final action. but agencies will be reluctant to take enforcement actions unless the violation is based on clear statutory authority. they won't be able to interpret ambiguous provisions to further their policy goals as freely as they have. they will also have to think "is it worth getting sued for this?"

the big agencies will also have problems with different interpretations in different circuits. if they significantly modify their actions based on which circuit they're in, i think there's a good argument that they're being arbitrary and capricious. so they're going to have to bend to the most strict circuit unless SCOTUS wants to spend all of its time on admin law cases.

Are NLRB enforcement actions /ulps under the common law per the 7th amendment? I doubt it. No doubt they will be challenged but I cant see the scotus requiring a jury trial in a unionizing case.

That's completely different from an sec fraud enforcement which is clearly derived from a pre existing common law crime.
