They are seemingly completely unaware of inflation and that no one is billing 500/hr anymore.

Can you appeal his shitty award or are you stuck with it. Could you provide additional briefing with rate sheets for various firms engaged in similar types of work?

Seems like some other class action firms would happily share their attny fee awards along the lines of rising tides lifts all ships?

It's very hard to appeal b/c appellate courts give so much "discretion" to trial judges in rate-setting. Unless he bases it on an impermissible factor (which he's smart enough to avoid doing) you can't really just say "that's not enough."

We had plenty data points and awards from other cases, but at the hearing he was just like, "meh, I'm not really sure about that."

Also, it's not getting any better because judges salaries and workloads are such SPS these days. So you're getting lower and lower tier attorneys who are interested in becoming judges. So instead of some big law retiree, you're getting Insurance Defense of counsels making 150k jumping on the bench to 180k and thinking attnys fees of 1000/hr are egregious.

why would he do that. he has a hugely successful 'solo' firm where he knows his practice area really well and gapes opposing counsel and gets great referrals. he is clearly addicted to the work.

law can be 'fun' when you have a bunch of advantages over the other side, i.e., are the plaintiff, can shape your claims, can prosecute the litigation as you see fit, are smarter than the other side. the anxiety is less then. it sucks when you are at a scorched earth bill-fest firm as a junior preparing a million expert reports with cravath on the other side.

this is cr. i don't make anywhere near EPAH money (about 500k as a partner at a midlaw firm), but i don't answer to anyone because i'm the only traditional labor partner at the firm, the work is pretty fun, and again i don't answer to anyone.

i am trying to amass over 5 million over the next 5 or so years, but not sure if or when i will step back from law. i think about doing it a lot, but i'm not sure i really want to stop. not now anyway.

There’s a Wolters Klewer publication called the Real Rate Report that obtains actual billing info from some giant billing database and sorts it all. It reported the third-quartile partner rate for antitrust litigation (on a national basis) at $1312. For LA commercial litigation, the third quartile partner rate was like $1061 or something for 2023.

But yeah, HS’s figure is wildly off.

Yeah and this pisses me off too. The test for rates is “rate prevailing in the community for similar work performed by attorneys of comparable skill, experience, and reputation.” But then our judge is like, “Sure you guys take your cases to trial and win, but the real skill lies in Paul Weiss litigators charging their client $20M in fees en route to paying a $500M settlement. Now that’s what I call litigation!”

He’s a former staTTTE superior court judge. Even when these types becum federal judges, they keep issuing “tentative” orders. His tentative said no multiplier, but I came back hard on rates at the hearing. He’s a savvy guy though, so I expect he’ll tailor his final order to avoid the errors I identified, but end with the same result.

The smart move in these circumstances is just to say “we disagree with the tentative,” without telling them where they fucked up. But he issued his tentative only 25 mins before the hearing, so I fucked up by being a defensive bitchboi and told him what I disagreed with. Probably cost myself $1m minimum. One wrong move is real.

cool ty. firm seems solid. they're in that weird nether-world between BIGLAW and midlaw. they're in the v100 and full service and i guess technically have a national presence, but they don't pay market to first years. i was curious what the deal was with them bc it's a crapshoot with those stats. such a firm can be really good, or a shithouse.

we'll see what unfolds. i doubt i'll leave bc i'm equity at my current firm and make high 400s/500. i know for a fact DWT won't take me as equity and i don't see them offering me more money, at least not enough for me to make a change. i doubt anyone here gives a fuck about any of this so not sure why i'm rambling, sorry.

from what i can tell, they pay first years in DC and LA $190k, and for some reason $200k in NYC and SF (odd because firms usually pay the same in all "first tier" cities). that isn't THAT far below 215 or whatever biglaw starts at.

that said, it's entirely possible that pay for midlevels and above isn't all that close to biglaw scale.

i'm really not inclined to move bc i just moved last year and i'm gonna look like a job hopper if i do it again but you never know.

You 100 percent cannot use first year salaries in this context to correlate biglaw pay scale for more senior attorneys. It is quite typical for these midlaw firms to compress salaries at the more senior levels and I know that DWT does that for a fact. They are not paying 7th years 500k, not even non-equity partners get this much.

yea, that isn't surprising. if that is true re nonequity partners, then that rules the firm out for me. i'm equity and should make close to 500k this year. their traditional labor team seems pretty cool though (whereas I am the entire labor practice at my firm).

BTW i was at baker hostetler, which i think everyone would agree is biglaw, and they do the same shit re compression. they shouldn't be considered biglaw tbh.
