Date: June 26th, 2024 1:48 PM Author: apoplectic shitlib property Wow. Have gotten Mental health diversion (penal code 1001.36) for a few clients who would have spent many years in prison otherwise, but not for charges as serious as this.
One of my clients on mental health diversion that did really well was an arsonist with schizophrenia facing a third strike (25 to life).
Most judges in our county would be hesitant to grant a mental health diversion motion when the diagnosis is “major depression” though. Harder to see a nexus between the mental illness and the commission of the crime for that one compared to something like schizophrenia where hearing voices/insane delusions are expected symptoms |
