CSC case is docketed in 2004. counsel appointed in 2008.

in april 2013, after 21 extension requests, defense counsel files a brief that's "150,082 words; 532 pp"

in oct 2013, the AG files a brief that's "89,205 words; 306 pp."

in dec 2015, after 6 extension requests, defense counsel files a reply brief that's "49,584 words; 193 pp"

in july 2024, defense counsel files a supplemental brief that's "15, 642 words; 61 pp"

in feb 2025, the AG files a response to the supp brief that's "11, 365 words; 46 pp."

in march 2025, defense files a supp reply brief that's "15,490 words; 62 pp."

in march 2025, OA is held.

in june 2025, the court issues a 217 page opinion affirming the death sentence

note the defendant is already serving life, and picked up a death penalty murder for killing a cell mate. no chance the guy actually ever gets the DP. he's already serving life.

and now this is just the start of the DP litigation. we haven't got to habeas stuff. this is just his direct state appeal. there will be decades more of this bullshit.

The AG and judges get paid either way. I'm sure the AG would rather not have to write a 200 page brief and I'm sure some poor judicial clerk would rather not have to write a 215 page opinion, and both would rather be working on other crap.

imagine having to read some massive transcripts and write a 200 page motion dealing with the DP in a state that has officially suspended the DP. you'd just stare at the binders briefly each morning and then turn to some project that matters.

Yikes, that's awful.

The funny thing is that a state DP appeal isn't even about death penalty issue. It's just about raising every possible borderline-frivolous garbage trial issue anyone can think of. If you read that 215 page opinion, it's just a bunch of general nonsense about jury instructional issues, evidentiary issues, etc. Much of it is not even about the death phase.
