If Trump was plausibly engagnig in some sort attack against teh US, then I think a court would need to decide if Biden was in fact acting in his official capacity or not.
If its plausible that Biden was correctly exercising his power over the military, then he can't be criminally accountable.
But the thought exercise is pretty stupid. It's not like this is the first law ever where people could use something as a pretext in bad faith. |
