Trump (or any citizen for that matter) could just run to court and say his civil rights were being violated and the court would let him out on habeas corpus grounds

The bigger question is what happens if potus orders a military strike against their opponent on the grounds that they were conducting a rebellion against the USA. There’s apparently no remedy there.

The president doesn't have power to use the military to detain his political enemies.

If Trump was plausibly engagnig in some sort attack against teh US, then I think a court would need to decide if Biden was in fact acting in his official capacity or not.

If its plausible that Biden was correctly exercising his power over the military, then he can't be criminally accountable.

But the thought exercise is pretty stupid. It's not like this is the first law ever where people could use something as a pretext in bad faith.
