Both sides in that battle were willing to fight to the death, it ended up being one of the longest and bloodiest civil wars in modern history, and it only ended after the North offered almost unbelievably conciliatory terms (the South was basically allowed to go back to self-governing in shockingly short order, de facto slavery was reimplemented as soon as reconstruction was abandoned, and basically no reprisals were issued against former "enemy combatants" including high-ranking Confederate officers) and the top leaders of the South were induced to take the deal.

Key word there being, "the top leaders." The Confederacy was a full-fledged baby nation, and we're not really envisioning a top-down political stratification in this Texas scenario; we're envisioning a bottom up organic populist rebellion that the Feds have to come in and put down.
