You COULD get declaratory judgment in small claims court, it would just be overturned on appeal

Are you taking the position that a court couldn't issue an order outside its jurisdiction and then be overturned on appeal? If so, have I got news for you

That might be what's on the books, but small claim court judges are retarded and can easily enter an order outside their jurisdiction. It really seems like you're not getting this.

If you're not prepared to generate your own power with diesel you're insane.

Okay and? Is it sitting in a box or have you used it to generate power

I have two 4 ton geothermal heat pumps, 2 water heaters, well pump, 2 fridges, freezer, etc. Had a generator guy come out for a whole house estimate and he came up with 48Kw needed, which just wasn't worth it given the infrequency of outages. Average power consumed during the worst winter month if we are here is about 6 Kw. Even with soft start each geo takes about 12Kw on startup and about 7Kw running full load. Have 400 amp 240 volt single phase service and a 25Kw pole transformer. Even with a 48Kw generator would have to bypass the heat pump back up heaters. Those are 15 Kw each, though they rarely deploy.
Edit: Put the well pump, fridges, freezer, one water heater, TV, router, etc., microwave and some lights on transfer switch 100 amp sub panel. Gen might handle one heat pump, but would have to load shed. Heat pumps take up multiple circuits, however. Compressor, blower, circulating pumps are all on separate breakers. Electrical entrance is a nightmare:https://imgur.com/0jwmQzK
