I'm guessing those same 18 are members of the US Chamber of Commerce.
I don't really have time for a full exegesis on the claims, but I think I can safely say that I know more about antitrust law than the rest of xo2024 combined, and this isn't a viable Section 1 case just based on 18 members doing the same thing. There would have to be some kind of agreement among GARM members, which I really doubt will ever be found. If Elon picked that Trumpmo in Amarillo who outlawed mifeprestone it will probably win in front of him, and he might be lucky enough to get two Trumpmos on the 5th Circuit, but not even the Trump SCOTUS would uphold this as a Section 1 case. And the "hardcore" lawyers Elon hired aren't sufficiently competent to even pursue it properly. hth |
