2 is a fair point, but his argument would be that he knows there's a gun and a struggle and one shot has already been fired, he doesn't have to wait until someone gets hit to use lethal force. |

1 seems perfectly reasonable to me. he knows this guy is interfering with law enforcement and resisting arrest while wearing a gun, why wouldn't he have another one in his boot or whatever? does he need to see it, or is the shot enough? i think the accidental discharge justifies the kill. that take has an obviously terrible policy implication, but i'm not going to assume that cops are going to intentionally take and misfire people's guns so they can execute them. it's just absurd shitlib fantasy that these guys are blackshirts.

Seems to me the probability is pretty low that a gunshot heard by the shooter is from a mostly pinned/controlled guy (who shooter is looking at and who does not visually have a gun), and not from anyone else in the crowd, other law enforcement, or an endless number of other potential sources. And obviously the gravity of shooting to death a disarmed and pinned/controlled guy is huge.
This all adds up to unreasonability in my estimation. |
