On the other hand, I think the circumstantial evidence against Wendi is very strong. As I recall, there were a bunch of calls between her and Charlie right before the murder happened. On the morning of the murder, she drove past shortporch's house even though it was a major detour on her route. And when she saw crime scene tape at the house, she didn't stop to see if her kids were okay. And there was testimony from one of the hitmen that Charlie insisted that they drive a certain model and color of car, which was the same as Wendi's boyfriend was driving at the time. It's not airtight, but people have been convicted on far weaker evidence than this. My guess is that unless they can find new evidence that can definitely prove that Wendi is involved, they won't arrest Wendi until they either get Donna or Charlie to roll over (or give up on trying). There was a rumor that the DA's office offered Donna a plea deal for time served if she would give up Wendi, but Donna refused. The DA's office denies this, so who knows? 2) she has qualified immunity and perhaps I'm out of my depth here but I don't think she can make blanket 5th amendment objections because the state has agreed not to use her testimony against her. You're just trying to spend a normal day with your kids and Danny is freaking out about whether they ate a hot dog. He was a total asshole but agreed he didn't deserve to die and murder is wrong but you can see so easily now how it happened. |

There is testimony from Jeff Lacasse that Wendi made sure he was in town with no alibi before both the initial attempt and the actual murder. And when Wendi was interviewed by the police, she immediately suggested Lacasse as a possible suspect. And when you combine that with the fact that she drove out of her way to shortporch's house the morning of the murder and never bothered to check if her kids were okay, to me, it becomes incredibly hard to believe that she didn't actively participate.
Granted, the case would depend very heavily on Jeff Lacasse's testimony. If her defense could could undermine his credibility on cross, it could get dicey. But plenty of people have been convicted on far weaker evidence than this. |

Wendi definitely knew, though. However, I will assume that the poaster above is knowledgeable about criminal law in Florida and that charging her requires proof beyond a reasonable doubt that she engaged in "action in furtherance of conspiracy." I take that to mean that knowing is not enough. They have to prove that she actively participated. But I don't know. As I think about it, maybe the state could argue that, at the bare minimum, she knew that her mom and brother were plotting to murder her ex. And if she shared information with them about his whereabouts, she had to know what was going to happen. |

Long story short the police found the most ghetto dude in the department, who was basically a fat Puerto Rican guy from New York with a Brooklyn accent (one defendant now serving life without parole called him a 'New Yorican nigga') to approach Donna in a ridiculous disguise on the street and hand her an envelope. In it was a letter that said your family is taking care of Katie and Sigfredo 'Tuto' Garcia but not doing anything for Luis 'Tato' Rivera. The letter mentioned that this guy knew about what Tato did for the Adelsons 'up North' (in Tallahassee) and wanted a pay out.
All the suspects in this case had their phones tapped and they were being tailed by law enforcement when they went out to meet in public. Any normal thinking person would intuit this was a police set up. The acting was atrocious but the cops were smart to target Donna who probably thought all Latino people were thugs.
All the conspirators basically cracked under the pressure. They all got really paranoid, started talking about it non stop over the phone using code words like using a real estate deal as a metaphor. They convinced themselves they really were being extorted by some gang members. They just kept spilling the beans on record. Charlie even called the police number which I thought was funny because he said it rang 30 times before anyone picked up which makes me think they were in an office and not some actual hoodlum.
Also any innocent person if they were being harassed by gang members would immediately call the police. They never did. They were afraid that the guy setting them up would go to the cops with information. This is classic one wrong move territory. All it took was some atrocious acting job by the police that any rational person would think is a police sting and they just went into a total frenzy. Giving away the bag. It's ironic because Charlie used to tell everyone he met that anyone can get away with murder as long as you keep your mouth shut. He did not keep his mouth shut. He went full retard. |

The case against her is pretty good but almost all circumstantial. The defense could even plausibly argue that maybe Wendi knew something was going to happen, but didn't participate in it. The link from the hitmen to Wendi is too attenuated right now.
I think the state should try anyway, but she'll probably walk which will be a tragedy. This family is evil thank God they're also unbelievably stupid. |

A lot of it is based on circumstantial evidence. You have to have more than just she was the prime beneficiary of Danny's death in a murder for hire plot conducted by her mom and brother.
Donna and Charlie's fingerprints are on everything. They plotted it, found the people, wrote the checks, got caught on a wire acting extremely guilty, two co-conspirators testified against them. An unindicted co-conspirator (Wendi) testified against them. These are slam shut.
What changed is in the Donna trial a lot more has come out about Wendi, fueling public antipathy against her. But the state still has nowhere near the smoking gun they have against Charlie and Donna.
But sentiment is really moving against Wendi and more people feel like you do. The consensus building against Wendi is so what if we don't have a slam dunk case against her. Do it anyway. I think a lot of people are coming around to that. It's going to be a very difficult trial to put on. For instance in the Donna case 90% of the evidence so far has been about Donna's co-conspirators, indicted as well as unindicted. So we'll see. I think the will of the people is bubbling up to seek justice against Wendi. It's getting more and more likely to happen. |

And she was totally fine staying in Tallahassee and decided it was actually better than Miami. Without Jeff's testimony, she could easily convince a jury that there was no motive for murder. Also, Jeff testified that not only did Wendi admit to hiring a hitman, but she also asked him if her kids would be old enough to remember if their father got whacked. This is the best evidence we have currently that Wendi was aware of the plot and supported it. Plus his testimony about Wendi grilling him about his travel plans followed by Wendi suggesting his name as a suspect at her first police interview. Jeff also testified that Wendi appeared to have deliberately damaged her own TV (giving her an alibi at the time of the murder).
Without Jeff, the case against Wendi is extremely circumstantial at best. Basically the only real evidence the state has are the fact that Wendi drove by the crime scene shortly after the hit and didn't check on her kids or call the police afterward and the fact that she lied under oath about hearing about shortporch's death on the way to the police station. Based on the evidence I have seen so far, Jeff's testimony will be absolutely critical if they want to take down Wendi. |

Own all of that and simply distance Donna. Hard to do with the evidence, but remember at all times the chain is linked Donna - Charlie - Katie - killers.
You just need to break/obscure that first link, and you do so by constantly painting Donna as a dimwit who knew nothing of criminality, but obsessively loved her idiot son Charlie.
Charlie concocts this whole thing. Charlie keeps it a secret. Charlie tells his mom, hire Katie, do this do that. Mom does everything, slavishly, without any real understanding of what is happening.
Mom having reasonable suspicion maybe her boy was up to no good is NOT furthering a conspiracy. Its simply really immoral and bad parenting. Maybe eat some accessory after the fact charge? Anyway, Main Story #1 is Donna is an imbecile grandma, who could be surrounded by crimes without realizing.
Main Story #2 is that these cases are making the prosecutors so famous, on 20/20 and in national news, that they are riding a gravy train and now EVEN COMING AFTER GRANDMA just to maintain fame.
Of course grandma was flying to vietnam. She was, at the same time, planning her suicide. She just wanted to die, disappear, vanish from earth, etc. Her baby boy was just convicted and he HAD BEEN USING HER THE WHOLE TIME, WITHOUT HER KNOWING. She wanted death, and vietnam is the same thing.
In a sentence, Donna is victim of Charlie and the ravenous prosecutors.
Thats how you fucking defend this case. Attack Charlie, attack the prosecutors, paint Donna as insanely in love with her son -- and you have reams of evidence to support each point. Probably still lose, but its better than using "every element beyond a reasonable doubt" as your story |

Fam lawyer expert was brought in to argue, basically, Wendi's divorce was nbd, not at all contentious, and therefore no reason to trigger a murder.
Georgia called her on being a dumb fucking lawyer who has no idea how normies are affected by divorce and custody issues. "Ever have a client suicide because of divorce proceedings?" Georgia asked, which I HIGHLY SUSPECT she just adlibbed.
"One crazy fucking muslim," the lawyer had to admit. "But thats cause he's from fucking Iran or some such hell hole where divorce is shameful."
Couldnt have been scripted better for the cross exam.
PS we are now seeing Wendi's defense: The divorce was OVER and SETTLED, and by the way was nbd, hardly contentious. Here's a train of female divorce lawyers to explain that, in their professional opinion, this divorce was nothingburger (except when shortporch mansplained things), and Wendi was now a strong and content divorcee with a big happy clit and black sista friends, with no reason at all to kill anyone over a divorce that happened, like, a million years ago, ancient history, hahaha |

The pitch is that the divorce was nbd, no one was rattled by it, the state has been hyperbolic about Donna's emails. Everyone gets emotional around divorce but it wasn't that big a deal. The whole thing was settled and there was no motive for Donna. Charlie is crazy and we have no idea why he set this up. Anyways, gotta go.
I think at this point the defense is as close as they can get to acquittal. I wouldn't even put Donna on which would backfire. Just hope and pray at this point. |

The divorce actually went fine. The custody arrangement wasn't that big a deal. Yes they said some mean things to each other in court motions. Big whoop. They were getting along fine. No reason for Donna to have a bug up her ass about it. The state cherry picked emails but that's not the whole story. There were ups and downs but Wendi and Donna were mostly chill and not freaking out all the time.
You see, you convince a jury that the divorce and relocation wasn't this hotly contested thing, it takes a lot of pressure off Donna. OK so she was pretty chill, no issue with Danny, no reason to do this. Then they can say well we'll never know why Charlie did this. But he acted alone.
This is actually not a bad defense. They seem to have discredited the jail house snitch. Assume you take a very rosy view of Donna Adelson that she's just this nice old grandma, that she was never irate about relocation. That she never confessed to anything or tried to flee to Vietnam, you're left with an outside chance of acquittal so long as the jury doesn't buy the states evidence. Conversely if the jurors believe Donna was turbo mad about relocating the motive is glaring and Donna is cooked. This witness is so in the tank for the Adelsons you wonder if she's on the payroll. "Yeah this custody battle wasn't contentious at all. By all accounts most people believe my client hired two hoodlums to bump off my son in law so I could take the kids to South Florida. But yeah, very routine proceedings. Very chill, mostly no one cared." ljl hopefully this backfires and the jury is mad as hell.
It's still 70/30 convict imo but it felt like 90/10 when the state rested. The defense clawed back a few points and left Donna with a couple outs. I think though that if the jury really look at the state's evidence, she's still completely cooked. It's still 'convict' but maybe we get totally surprised by the jury. They have to put on their thinking caps and look at the overwhelming evidence against her. Will they? Time will tell. |

The other egregious error, IMHO, is that the defense made absolutely zero attempt to refute any of the "bump" conversations. Granted, there was only so much that they could do, but you could at least ask a few questions to muddy the waters a bit:
"After playing eight hours of recorded conversations, isn't it true that there is not a single mention of Dan Markel, much less a discussion of a murder for hire plot? And isn't it true there isn't a single conversation where my client talks about paying Katie for the murder? And isn't it true that Charlie Adelson clearly stated that Katie worked on weekends, so his mother would not have seen her in the office?" All it takes is for one juror to think, "Holy shit. After making me listen to recorded calls all day, there is no smoking gun on here. Maybe the prosecution is blowing smoke." Instead they made basically zero effort to refute any of it either during cross examination or closing statements. |
