When I was in litigation I literally sent two subpoenas to the wrong parties. I mixed them up. So the parties got each others subpoenas. The partner was fucking livid and I nearly got fired for it. Had like a two hour lecture. Lmao

That's pretty bad, but not awful. Simple clerical error, maybe even possible to pin on a paralegal/staff. Doesn't seem like there'd be any long term damage. What did the guy even say for 2 hrs?

I've seen someone send a strategy email intended for the internal team to opposing counsel. I've also seen at least one brief filed w/ arguments based entirely on overruled case law. Another good one is publicly filing a brief that should have been under seal.

Luckily it was a relatively minor discovery thing for which there wasn't any argument. Judge just put out a short docket order ruling for the other side. I don't know if the partner on the case ever fully understood just how bad our brief was. Luckily it was a minor enough issue that he didn't pay much attention, otherwise he would have been livid. I never trusted the junior who wrote the brief ever again.

It actually wasn't even that bad. The parties were super understanding and said they'd respond to the subpoenas with no need to send them out again. But the partner of course made me get them served again. And he made a huge deal about it. Fucking redfaced and yelling and screaming. "Are you fucking kidding me?" he must have said like 5x. He called another partner in and we sat there and he just talked about how being a lawyer is detail oriented and he wasn't sure if I was cut out for it and how I was damaging client relationships and all this shit. It was miserable.

We (team of about 8) got the timing wrong on a huge MSJ as well as several other related motions in a 100 million dollar case due to poor communication with local counsel. Probably spent 400-500 hours on the motions in total. They all got bounced without ever being read by the court.

This epitomizes Biglaw imo. The hours spent on some motions is incomprehensible. You are talking about a total procedural fuckup, but almost just as bad is spending 100s of hours on novel legal theories to "mount a defense," just to get categorically annihilated across the board. The worse your legal position, the more time you spend crafting turds to throw at the wall.

Isn't that sort of the point, though? If you had a clear-cut winning legal position, you presumably wouldn't need to spend a lot of time trying to figure something out. And hey, sometimes it works.

Sounds like local counsel fucked up huge if they didn't clue you in on filing deadline. Describe communication issues?

I always read the local rules start to finish when I have a case in a dst im not familiar with. Saved our ass one time on filing a responsive motion. I'd submitted it to the partner to review two days before, then called him day of (he was out of town on a depo). I was like yeahhh we kind of have to file by midnight. He reviewed them on the plane, said papers were great and I got it filed by 11:50.

Next day he bitched the paralegal out like crazy and said "you would have fucked us if pumo hadn't saved our ass." She tried to argue about the deadline claiming it was a week later (our local rules) and the partner screamed at her some more.

Partner was more dickish to her than justified, shocker, but I won a ton of credibility with him.

Local counsel was a moron, but she was friends with the top in-house counsel in the whole company. I never really found out exactly what the issues were. It was ambiguous as to whether local counsel got it wrong or whoever she communicated the instructions to got it wrong. All I know is my motion which I spent a good 2 weeks on, including weekends, never got read.

was this in state court? i can't recall seeing local rules modify Rule 56 in a punitive way--even if they set this or that deadline you can always request to expand time.

Did you explain what happened to the judge and claim excusable neglect? I can't imagine a judge letting a case that legitimately should be killed at summary judgment proceed to trial instead just because a date mix up meant the MSJ was filed late.

We didn't know the local rules and trusted our local counsel. She was a moron and didn't give a shit. Internally we had five different partners across two firms and three offices viciously fighting wih each other for control of the case, and nobody was really running things. It's hard to put into words how poorly we did everything, given the stakes. All the associates were convinced we'd be getting deposed in a malpractice litigation.

really bad cases in the interim? i've done shit like this, filing a brief weeks/months after writing it and not looking for recent case law. never really been burned, but a few "oh shit" moments when I realize there was some intervening case I probably should have said something about.

I'm confused by your story. You wanted to just rock and fire the brief without rechecking the cites but the partner wouldn't let you?

It sounds like someone more junior was tasked with cite checking, did it, and everything was fine. Not following where the huge fuck up is.

I've never worked biglaw, but I spent a few years at this boutique firm that considered themselves competitors with biglaw firms.

In my interview I completely lied when they asked about my computer experience. I said I could build a computer from scratch or something like that. The partner was so impressed he said I would earn my keep just helping out with the various computer problems around the office.

I had my black lab at the time and she was old. For lunch I'd drive home, walk her around the block, hit the vape real quick and go back to the office. My job was boring as fuck.

I was only there a couple of months when I saw that I couldn't save anything on my firm laptop because the IT guy loaded the entire firm's files on it. To create space I decided to delete one of the partner's files from my laptop.

The fuckup was that when I deleted that partner's files my laptop was plugged into the server. I hit 'delete', confirmed (I was given admin privileges by my partner) the delete command, and went to lunch.

When I got back from lunch, stoned, everyone was freaking out, especially the partner who was literally watching his files being deleted in front of his eyes.

Telling them it was my fault was a total buzzkill.

No, I lasted there two years and then was laid off. I do think my days were numbered after that. Absolutely miserable job. Hated my partner more than anyone.

I ran into the fucker in court once about a year or so later. I was unemployed for almost a year when I finally got hired at a new firm.

My client was sitting next to me and she didn't speak any English, only Spanish. He comes up to me and says hello. I don't stand up or shake his hand. I think I just looked at him. He goes, "Can we talk over here for a second?"

He asks me who I'm working for, what I'm doing? I give him some terse, sarcastic answers before he goes, "Well, I just wanted to say hello because it would have been weird if I didn't," and I just walked away from him.

He sat across from my client and me. I started trash talking him in Spanish to my client who wouldn't stop laughing. I was calling him all sorts of curse words and shit. Made my day.

It was really fucked up because the IT guys couldn't restore it. They were able to restore everything except for the last two weeks. Something really important was lost forever. It deflected most of the blame over to the IT guys in the short term.

It's probably one of those firms where all the partners are a hundred years old and hate dealing with technology, so the actual legal practice aspect of the firm is good, but the technology part is backwards and shitty.

You know how law firms always have a few (or several) partners that like printing everything out and sending/receiving faxes, and hate doing anything that involves navigating Outlook or scanning in a document?

Funny you say that. My partner who was in his late 50s was up on all the latest technology. Paperless files.

They had this small IT firm on contract. A father and his son ran it and they were both complete fucking idiots, but my partner was loyal to them for some reason, even after they didn't have a working backup system in place.

Whenever there was a problem, we'd have to call them and schedule a time for them to come out. I think they figured that there would be problems I was qualified to solve quickly without having to call the IT guys.

Thanks, bro. I had four years of high school spanish. When I was unemployed my resume said that I speak, read, and write "conversational Spanish" although I had forgotten most of what I learned in high school.

When there was only 1.5 months left on my UI benefits I had this second interview with this shitlaw firm. Interview was conducted in Spanish. I bombed it. Partner told me he'd love to hire me, but my Spanish is terrible and it is a prereq. I told him if he gave me a shot I'd be fluent in 30 days. I worked there for three years before my current firm poached me nine months ago.

Forwarded email from client to jr partner with message "client is in full blown panic mode." Accidentally copied client on email. Client responded "I'm not panicking, just trying to manage." Fortunately the client was cool about it. Jr partner decided to sit me down and lecture me about the errors of my ways. So painful.

This was a few years ago, and my firm offered the option to port your personal cell number to your blackberry so you didn't have to carry around two phones. That was handy, but all your personal contacts were merged with your biz contacts.

My gf was out of town, and I went out with a few associates, got drunk and went home. Even now I'm embarrassed to admit that the text said something like "went out for drinks with my soulless fuckface coworkers, probably should have driven home" and the rest was about how I missed her. Emailed it to a low-level govt attorney, and was terrified she was going to absolutely fuck me. Wrote her a mortified apology email basically begging her to keep it to herself. This was before I knew they could give a fuck and she was probably just happy to ignore both emails.

Forgot about a (minor) regulatory deadline until the day before it was due. Client had to ask the regulator for an extension the day before -- which we got, but they* were pissed. Would have been far worse if I'd missed it altogether, but still caught some shit for it.

*by "they" I mean some total flunky in their in-house group who was not even a lawyer and probably made ~$100k and whose only solace in life was attempting to boss "biglawyers" around. This wasn't even on the radar of anyone important.

Didn't realize some important shit needed to be filed the same day as dispositive motions until we saw the other side's papers hit the docket. (The judge's individual practices made NO sense whatsoever, but that's another story.) Basically did a markup of what the other side filed and got it in just in the nick of time. Our whole team was scared shitless, but the partner was very Zen about the whole thing and used it as a teaching moment. It was one of the few times where I really respected how a partner handled a difficult situation in biglaw. He didn't yell, there was no finger-pointing, and there is zero chance anyone on the team would ever make a similar mistake again.

I went out one night with my friends and got shitfaced and did a bunch of really good coke. When I got home at 3 in the morning I was still feeling pretty good from the coke, but starting to slip into the comedown phase where you are still wired but the euphoria turns into anxiety and guilt. One of the guilty thoughts racing through my mind was re underperforming at work and being behind on shit. So, in my coked up logic, the way to assuage that guilt was to get workin'. I got on my computer and started doing legal research and cranking out a memo while yakked out and drunk. Ended up emailing a partner something at like 5:47 on a sunday morning that read like Hunter S. Thompson doing legal work.

I don't think he paid any attention to the timestamp, and I think the idea that I would churn out a stream-of-consciousness legal memo while high on drugs didn't even cross his mind, so he probably just disregarded the weirdness.

I was supposed to determine if a governmental agency could trade certain products. I saw a general statute that said "govt agencies can trade x products." So, I told the partner that the agency could trade x products. I forgot to look up the definition of govt agencies, according to the statute, and I got grilled for it. There was some ambiguity and the partnet had to supplement our initial response. Pretty sure he hated me after that. Blew his fucking lid and didnt talk to me for like a week

Partner had me send an agreed order to set the trial date to opposing counsel. I expected the other side to get back to me, so I was waiting to put the trial date on the firm calendar once they got back to me. I never heard anything back, and forgot about it, assuming that the partner had dealt with opposing counsel on it. Somehow (still not sure how) the trial date was set without me or the partner ever finding out. We get a call 2-3 months later one morning from the judges office, saying that everyone was ready and waiting in court, and where were we. Partner had to run from his desk to the courthouse to get an extension. Thankfully the judge and opposing counsel were ok with continuing it several weeks, and it worked out ok for the client.

I was mortified. Offered to resign. Partner was cool about it, joked that I would never make this mistake again. Still here several years later.

Q for all the biglaw peeps in here:

how do i subpoena a biglaw firm for the non-privileged documents in a transaction they did?

defendants in our case did a transaction where Biglaw & Co. was the adviser. partner at Biglaw & Co. has agreed to accept subpoena for all documents, without waiving privilege.

what do i ask for?

I had my share of routine fuck-ups-- missing an email from a parter, not quadruple-checking to make sure a partner didn't miss an email from me, etc.-- but my biggest ONE | WRONG | MOVE was something that, when I did it, seemed completely harmless: I got really good at navigating the shitty data room software and getting around the productivity-destroying "security" features they have (e.g., I had a greasemonkey script at the time that could usually evade any purported anti-downloading features, then I could run the PDF's through our own OCR to make them searchable). Seems harmless, right? Wrong.

People who have been in biglaw for a while already know where this is going: Suddenly, I became the guy for any and all non-trivial data room related tasks, even on deals I wasn't really on. "Oh hi, this is senior associate x on matter y... we got you data room access. Can you download all the contracts? And flag any that have a provision that might be triggered by a change of control? Is it possible to organize them by counterparty?"

This was easy billables and nobody really questioned hours put into it, but the assignments themselves were terrible. Being the "trusted" person with a shit task is the worst of both worlds in biglaw.

I had a case for a bank client and they gave me their bottom line settlement demand.

I thought I wrote it down in the file, but I didn't.

Anyway, opposing counsel calls a few days later and asks me my bottom line demand. Because I was under some time crunch in another case, I didn't check back with the client and gave him the $ figure I thought I remembered.

He called back the next day and accepted.

I called my client to give him the good news that opposing counsel offered X and he said, "Rudolph, will he move some more, that's $10,000 below our bottom line number."

I responded with something like, let me see what I can do.

I did nothing for 3 days and called the client back and said he isn't moving and the client mercifully decided to take it.

Two mistakes in same case.

1) We had rogs due. I sent them to OC on a CD because I was rushed for time. When they got it the CD had a virus on it (fucking IT) and brought down the opposing firms system for like 15 minutes. (This was a V5 firm). They were pissed because my answers weren't even available lol.

2) I was managing a document production around 40k for same case. I distributed it jr. associates. Had everything redacted re-recopied and burnt on CDS. Well I also had like a summary of the doc's highlights and condensed version for internal use. One of the fucking jr.'s put it on the bottom of the stack of docks and it literally got sent to opposing counsel. They sent it back saying 'think this is privileged...' directly to head partner. I was fucking screamed at so badly.

I was cced on an email between a partner and client about setting up a time to talk about some work they were interested in. At some point, a calendar invite for a 1 hr con call was distributed and I accepted, assuming that I had nothing much to do with the call and was just going to sort of listen while screwing around on the internet and take a few notes.

3 minutes into the call, the partner emails me to say 'I am going to finish warming them up and then you can take over.' This is the first time I had been given any indication that I was to do anything at all with this call as I was pretty junior and had never even spoken to the client and had no idea what we were supposed to be doing. I began winging it and the partner kept emailing me "helpful" notes about my performance. At some point near the end of this tortuous call that I somehow bluffed my way through, the partner emails me with subject "Feedback" and says he needs to talk to me after the call. Obviously this is not a helpful email.

After the call, he criticized me for sounding uncertain when answering detailed questions related to an area of law I am in no way an expert in and making the client think that we had not spoken beforehand and were "not on the same page." I apologized profusely.

Yeah this was definitely a huge screw up on my part for just assuming that a big swinging dick type partner was going to monopolize the call while I billed an hour for doing nothing.

I learned a valuable lesson about preparation and making sure I understood how I would be participating in stuff, and the client gave us the work, so it all worked out in the end.

Negotiated a stupid contractual provision that required the client to provide certain compliance info to the other side by a specific date that happened to be the first business day after a major holiday. With a bit more effort, could have avoided that entirely, but I was feeling lazy and thought client would do thhe heavy lifting. Ended up billing tons of hours trying to get ahold of people before/during the holiday and determine what it was we were going to tell the other side and how it would be communicated. And then blew past the deadline. Thankfully, the other side didn't really make a fuss, and there was no heat from the client or partner. Never again.

It's funny how lawyers look at contracts vs. business bros. For business bros they are loose guidelines at best. Almost everyone is not compliant with some provision of a contract but it's no big deal so long as the relationship is beneficial. It's such a joke.

Was doing some doc review at home while drinking beer and marked an email w attachments for production which was privileged and was sensitive. Months later client's GC called me directly to chew me out but I clawed it back and it was NBD. I've since decided not to drink beer while doing doc review.

Partner had me go though this old statute to look for a particular provision he'd heard might be in there. It was a 100 year old statute and archane as hell and I spent half a day reading the damn thing and could find any provision like the wine we were looking for. So we told the client yeah theres no rule in there. Then the next day I was sitting in the partners office and he was randomly reading a section of the statute while looking for something else, reading aloud, then happened to read the exact fucking provision I had not found. He chewed me out with this sad sad tone of disappointment.

Step 1: Write an add-on for Outlook that let's you tag email addresses as "firm," "client," or "opposing counsel". If you ever write an email addressed to both "opposing counsel" and ("firm" or "client") Outlook pops up a box asking whether are you sure you want to send this email to both "opposing counsel" + ("firm" or "client").

Step 2: Profit.

so many big mistakes

+ scheduled depo with important third-party W whose favor we had to win. didn't make it clear to W that the dep was rescheduled, W showed up to empty conference room.

+ filed major MSJ, where the key arg was "SEC filing says X." turns out that SEC filing was amended to say "SEC filing says NOT X"

+ filed major post-trial brief w/citations that didn't make sense. like it'd cite to dep transcript and the cited lines would just refer be like "Hello, My name is X"

"Yes, it looks like [DOCUMENT]."

"It appears to be orange chicken."

Enormous case big research task we are working like mad. See a case on point and flip it to the senior saying this is interesting. Go on to other things. Senior is like damn this is good who takes it to the partner who tells the client we figured it out!

I didn't shepardize it. We didn't figure it out. Got tucking reamed for hours by an autistic partner. Sneered out by senior. Next two months they basically haze me with bullshit as punishment.

Local counsel for a case was the only person on ECF for a while and didn't tell us (or notice) a partial motion to dismiss. We missed the deadline, and defaulted on the partial MtD. Client fired local counsel.

Personally, as a super junior associate, I spent 20-30 hours adding record citations to an appellate brief, but it was one of those thing where the partner had written the factual section of the brief as to what he wanted it to be, and not what the record actual said, so basically, I couldn't find citations to any of it, but just put in the closest. We got called out by the other side about how shitty our citations were, and the client was pissed that they'd paid tens of thousands of dollars for me to do to citations and they were not accurate.

In retrospect, I should have had a difficult conversation with the partner and told him what he wrote in the factual section was not supported by the record, and he just needed to re-write it or know that the citations were no good. I didn't do that. I honestly was sick to my stomach for three days, but I didn't get dinged on it in a review or anything.

Settled a case for $1500 in very favorable deal and did not have client approval. Freaked out when partner pointed this out and offered to pay out of my own pocket. He made me call the client and explain what I had done and the client got very upset and started citing the model rules. He was screaming "It's Rule 1.2! We're not talking about 7.4(b) here! It's the second fucking rule!" Turns out client and partner were busting my balls the entire time since my confession. Thought I was going to get disbarred.

Cr. That's why corp is better. You don't have a judge & opposing counsel scrutinizing ur shit. And even if opposing counsel finds a fuckup they will just be nice about it in a deal because both parties are just trying to get something done not trying to be fucking dickheads to each other.

There are at least as many mistakes in corp but they never come to light because once the deal is done its not very likely that somebody is going to dig out those documents and go through them line by line looking for errors in the same way that opposing counsel will always do in lit.

As you get more senior Corp gets better though. I'm just a newly minted 4 th year but I delegate that type of shit work to juniors and just double check it, which is easy enough.

But junior Corp work is truly awful. Then again, doc review is pretty terrible too.

This is one I actually avoided -- partner/client wanted to just have the vendor do search terms and not pay for anyone to actually look at it. I'm paranoid, so I checked. Literally the second doc was, not even a strategy memo, but literally an outline/budget of their entire settlement position. We would have been pretty fucked if this had gone out.

I billed 120 hours to a matter that the partner didn't like. Turned it in 3 weeks before the deadline so he ended up giving it to someone else who billed another 60 on it. All deadlines met. He ended up cutting only 7 of my hours but acted pissed and told the client I billed too much time.
