The suspect had demonstrated he was determined to avoid apprehension, and he was moving towards the officer to beat his ass.
As a matter of departmental policy, it would be perfectly reasonable to implement a policy where the police disengage in such situations instead of using lethal force. However, just because one reasonable approach to this situation does not entail the use of lethal force does not preclude the reasonableness of using lethal force from a constitutional perspective. It was perfectly reasonable for the officer to fear for his life in this situation, meaning it was a good shot. |
