The Senators elected in 2010 had terms that expired on January 3, 2017. The Senators elected (or re-elected) in 2016 had terms that began at noon on January 3, 2017, when they are sworn into office by Vice President Joe Biden, whose term does not expire until January 20, 2017.

Joe Biden could hold off on swearing in the new Senators. During that time, the Democrats would control the 66-member Senate, confirm Merrick Garland to the Supreme Court, and officially count the Electoral Votes. In counting the Electoral Votes, they could refuse to certify the electoral votes of Pennsylvania, Michigan, and Wisconsin, forcing the election into the House of Representatives and the Senate. The House would elect a moderate Republican as President, and the Senate (still before any of the 2016 Senators are sworn in by Biden) would elect Tim Kaine Vice President.
