So we settle the case, send over the releases, two months later, we don't have the releases back and the plaintiffs and their lawyer (contract lawyer) show up for deposition, we ask why and they say "oh we will get them to sign the releases." Well the clients refuse to sign the releases and they ask if I can take the deposition.
I send them home told them I'm not ready and send a nasty email about how incompetent they are.
A few weeks later, we settle the case again and send them new releases. Plaintiffs attorney never says anything to us.
Yesterday, they showed up for the deposition again. I yelled at the appearing attorney. |

Date: December 13th, 2017 1:09 AM Author: pungent lemon pit We auto-notice because claims hounds us for dates. The second settlement numbers were significantly increased. I told the plaintiffs attorney were just going to try the case now.
They're the type of firm to not respond to discovery so I'm going to send them (personal service) RFAs and file a motion to deem RFAs admitted when they fail to respond (initial discovery was two months overdue) and panic them into settling. A lot of firms auto calendar 35 days so to be a dick I send out RFAs personal service and file the motion when the deadline passes. Easy cut and paste motion and gives us huge settlement leverage. |
