what are moishe's obligations with respect to the two books? |

They send a second as good business practice almost certainly knowing that things do not get lost in transit in the modern age. They chose the shipping company and they chose this action.
How can they create an obligation on him to ship a book back to them? What is the basis? |

the first book is considered a lost object.
the threshold question is whether the vendor is a jew.
a jew must return lost objects to another jew. so, if the vendor is a jew, moishe needs to make a reasonable effort to notify the vendor and ask them how to proceed. the vendor needs to mitigate any loss by moishe, i.e. arrange for the return shipping and not inconvenience him.
a jew generally has no obligation to return a lost object to a non-jew, and in most cases he is specifically FORBIDDEN from doing so for various reasons (eg it will make jews look like fools and suckers). the only time a jew is even permitted to return a lost object to a goy is if it will make the jewish nation look good.
if the vendor isn't jewish, there's no evidence that moishe would get goodwill for the jews out of sending the book back. |
