if you entered illegally your wife CANNOT sponsor for your green card. You think ppl wouldn't apply if it was so easy? Illegal entry bars you from getting a GC through your spouse UNLESS you first leave the country and stay out for 10 years.
Your spouse can get you a GC only if you entered the country legally. ironically you can actually overstay your visa (*only* certain visas like student, work visa etc) and be here illegally and you can still get legalized by your american spouse. But the key is that you must have entered the country legally after inspection by an immigration officer. |

he has an even bigger problem than a regular blue collar guy applying for a visa - so he is married to an american spouse. lets say he goes back to mexico and applies for a visa. what does he do about his wife? if he lists her then he will get busted bcos they will ask him how did you marry her in the US? so it will be obvious he was an illegal. if he doesn't list her and then she files for GC he will again be caught when they review his petition and see that he lied in his visa application as being unmarried
