Not a former clerk, but I thought the panel took an initial straw poll after the arguments that day

Correct. They went back and met after argument and did a straw poll. Occasionally (rarely) someone would flip after the opinion was written.

i understand they do straw pole that day. i want to know (assuming no one flips, per below) how long it usually took for them to get the opinion out after argument.

This varies a ton. Some judges will have an opinion out to the panel in a couple weeks others take months. Courts track stats internally and have rules about how late you can be but there is no real enforcement mechanism.

Last COA case I had, the arguments were in March and the opinion came out in mid July, and I consider that fairly quick

The judge would be back within about 30 minutes of the argument with the results of the straw poll.

Some would be published within a week. Some took a year. Sometimes it had to do with how challenging the case was. But some judges are just slow as fuck and don’t seem to care.

Every CAFC-mo representing appellants gets that ICE COLD FEAR at 11am the next morning when they check ECF to see if they got a R36.
