IMO it's clear the trucker saw her. When she cuts in front of him he speeds up. You can tell because the gap between him and the nissan in front of him closes and neither the nissan or pickup in front of it touched their brakes. He also veers to the left before impact reacting to her trying to invade his lane.
My conclusion is that they are both to blame at different points, but the accident should have been avoided and was ultimately caused by the Trucker's aggressive response. |

1. traffic is going up a slight hill. 2. all left lane traffic, including the semi, accelerate while on the uphill. the semi starts accelerating around the 11 second mark, before the merging woman even appears on camera. you can tell by the timing of the lane lines. the semi accelerates slightly more than the cars in front, causing him to gain on them. 3. merging woman first signals a merge at 16 seconds. at that point, there is not enough room to safely merge. it appears to be a larger gap than it is due to the wide angle of the lens in the semi's camera. lane line markers are 10 feet long with a 30 foot gap in between. looking at the lane lines when the merging woman first signals, there is maybe 15-20 feet at the absolute most between her and the car in front of the semi, and ~10 feet between the rear of her car and the front of the semi. at freeway speeds, that's an absolutely retarded merge. the california dmv handbook says: "Any time you merge with other traffic, you need a gap of at least 4 seconds, which gives both you and the other vehicle only a 2 second following distance." 4 seconds at 65-70 mph is about 400 feet. 4. merging woman crosses the lane line between 17 and 18 seconds, 3.5 seconds after clearing the front of the semi in the right lane and 1.5 seconds after signaling. probably not enough time to ensure a safe merge. as she merges, she slows down more, causing her to fall in line with the semi. even in such a dumbshit move, she might have pulled it off by accelerating very close to the truck in front of the semi. 5. by 19 seconds, when the merging woman is headed into the left lane, the semi is both pulling left and slowing down in relation to the lane lines in an attempt to avoid an accident. at this point, the merging woman has 4-5 seconds to pull back into the right lane and brake before running into the truck ahead of her, which she does not do.
verdict: merging woman at fault. semi was accelerating before she appears, not in malicious attempt to stop the merge.
also, TMF is right: the burden is on the merging car to avoid accidents or disruptions to the flow of traffic in the other lane.

3. You are in a 3,000lb box one foot above the ground. He is in a 30,000 box 6 feet above the ground. A collision is equivalent to a train running over a soda can. When driving, you MUST understand that trucks handle closer to trains than cars. Research youtube vids of trucks going downhill in the snow, or truck-car collisions if you don't understand this.
4. She's lucky she didn't die, and potentially kill others, due to her negligence. That merge was a death wise, especially considering the proximity of the second truck. If there was another truck behind her, she would have most certainly died. Driving isn't about being badass or testing the limits of the law. Its the most dangerous thing we do on a daily basis and should be treated accordingly. |

The truck could have, at that moment, sped up or slowed down, without any liability because ultimately the truck had the right of way. My point was that even though it didn't end in an accident, the car would still get a ticket if a cop saw because it was breaking the law.

1) He shouldn't have been in the left lane
2) He's one of those people that doesn't maintain speed in the left (passing) lane, which generally fucks up the flow of traffic, causing people to weave in and out of lanes (making it more dangerous for everyone). This is evidenced by the fact that someone else merged into the lane right before the person he hit.
3) As soon as the blonde (not sure how this fact is confirmed?) puts her signal on and starts merging into the lane he accelerates to try to stop her.
4) The point at which she continues to go in and he continues to accelerate he did not make contact and she was near another truck. Therefore, he should have slowed down. He was the only one who could have prevented an accident at that point and chose not to.
Don't get me wrong, I hate people that merge into your lane when there is little room to. But I also hate people who ride in the left lane too slowly... they are the cause of a huge chunk of accidents. |
