On February 23, 2018 your insured, REDACTED made an unsafe lane change and struck our client, REDACTED. Mr. REDACTED attempted to avoid the collision but was unable to. The impact caused him to lose control and collide with another vehicle. Mr. REDACTED’s body struck the asphalt violently. The California Highway Patrol arrived at the scene and took statements from all the parties. The CHP report places your insured at fault for violating VC21658(a). Liability is obvious. Immediately after the incident, Mr. REDACTED was taken by ambulance to Cedars-Sinai hospital. His complaints were pain to his neck, back, testicles, penis, left hip, pelvis, abdomen, left elbow, and left humerus. He also had bruises and cuts all over his body. The injuries he has suffered have been life change.

While his neck, pelvis, hip, abdomen, elbow, and back pain have severe pain, his penis injury is catastrophic. During the accident, his penis was crushed and the majority of it was covered in bruises. He has not been able to have sex, has pain urinating, and feels constant pain in his penis. He is scheduled to see a urologist to determine the extent of the damage to his penis. He has been depressed, nervous about the functionality of his penis, and concerned about his ability to have children in the future. Attached with this demand are photographs of the injury to his penis.

Based on the foregoing, our client has authorized the undersigned to resolve this matter for your insured’s entire policy limits for REDACTED. Because of the nature of our client’s injury, there is significant exposure to your insured. We believe if this case went to trial it could be a seven-figure verdict. Failure to tender the limits puts your insured at risk of an excess judgment and exposes Mercury to an assignable bad-faith claim. As a condition of our demand we require that the following conditions are met:
