Closely held business entities are not like big companies with a publicly named board, officers, and records that precisely identify the shareholders of the entity and wholly owned subsidiaries etc. We're talking about shell entities that are incorporated and organized in a state without having to identify who owns or operates it. The defense lawyer here could be talking about a particular entity with the Concord name.
A couple of years ago I represented a plaintiff investor in a startup. The startup operated through a dizzying array of entities the structure of which virtually no one on the planet could name and understand with any precision. We named as many of the entities as we could find (and associated d/b/a's) and of course defense counsel countered in its MtD that these entities were either not in operation or not related to the transaction at issue. They bought themselves some time but weren't successful in the MtD. |

I practice exclusively on the civil side, but it just seems to me that before a company is indicted for a federal crime, the prosecutor should figure out whether that company existed.
If that's too much to ask, then that's a big problem with our criminal justice system. |

No, not necessarily. If these guys were doing business under that name (signing contracts, letters etc.) and then later officially organized/incorporated with that exact name, then I don't see an issue with naming the entity as a defendant. |
