Date: May 16th, 2018 4:35 PM Author: tan mediation Client was going to her car to get a book at her local community college. She stepped in a pothole and broke her ankle. Had a minor surgery. Meds were very low, only 11K because health insurance paid. Our theory of liability was that the parking lot used to be a bunch of basketball courts. Our expert told us that they were supposed to increase the thickness of the asphalt to support the weight of the cars. They never did that so the parking lot had a ton of potholes and cracks.
Case was probably worth more but she was a gymnist and continued to compete even with her broken ankle. She actually had her best competition results like a month after the accident. Her explaination was that it was her last month competing and she didn't want to miss out on the experience.
Also, we didn't get the case until almost a year after the accident. We had to file a motion for permission to file a late government claim (because the SOL is 6 months for government claims). Her mom had a bunch of mental health issues and the judge found it was a good reason to be late.
Really nice girl. We became friends and she is actually coming over later today to see my baby and say hi. She works at the local vet office, so I take my dog to see her when she needs something. |
