No. That's not quoting.

I think brackets are the best way to handle most errors.

If you want to change that mistaken "statue" to "statute," use brackets: "[statute]."

This is the way to go. Changing it without saying anything is dumb. Quoting things incorrectly is only going to lead to trouble later on. But pointing out errors is catty as fuck. I'm sure a professional copy editor would find plenty in your cleanest work. If the other side is sloppy as shit, the judge will have no problem realizing that himself.

Context matters. The substantively inconsequential errors of an opponent acting in good faith usually don't warrant a [sic].

But there can be other situations, such as where similarly named entities are misidentified.

Once with a pro se plaintiff I put a generic footnote saying something like "plaintiff's brief is quoted throughout without correcting for grammar and spelling." I thought doing [sic] [sic] was dumb, but I didn't want to clean up his atrocious writing for him.

If the [sic]'s are so bad they're distracting, that's probably the best way to approach.

Tastefully change the quote to the correct spelling using brackets, you impotent little fuck.

Opposing counsel will frequently notice (and eventually a judge will, too), and they'll recognize that you're an elegant understated attorney of yore, not a limp-dicked coke-bottle-glasses-wearing queer who's carrying around anger about his son being the social outcast on his little league team and his wife cheating on him at her job, and vents by filling his shitty briefs with bald characterizations like "frivolous" and starting sentences with "Remarkably,".

EDIT: I want to punch faggots like you in your fleshy punchable faces.

The real risk is the clerks. Many of whom are 25 year old hypergunners fresh out of law review, where the Bluebook was LIFE. They might actually expect you to follow all these [sic] rules to the t, and look down on you for not doing so.

were you a clerk too? my sense from having been one and worked alongside a number is that they're just looking mostly at the facts and the law at the end of the day, as informed by their understanding of how the judge is apt to want to deal with them. the errors and omissions from counsel that can matter are coming off as a true liar or moron, in which case sure, maybe your arguments will be examined a bit more closely (but everything substantive already was going to be looked at closely anyway).

Cr, also you have to rationalize the countless wasted hours spent on law review pretending stuff like whether you italicize this or small caps this or if it’s Sec’y of State or Sec’y of St. matters. Oh or the different rules for this self important state appeal court versus that self important state superior court.

On second thought just do [sic] throughout. They’ll either be self aware enough to see you as a fellow sufferer or still believe it’s important.

Ugh.
