You might quibble about whether that's the "technical purpose" of appellate courts, but that's the most important function of the court since any given appellate decision will likely impact dozens, hundreds, or even thousands of future proceedings. If each case is an island in LA, the appellate courts there serve a very different function than elsewhere.

That’s a narrow view. A huge portion of what a state scotus does is interpret the constitution and statutes and resolve splits among its lower courts and create common law. If the Louisiana scotus binds only the parties before it then that takes away a large part of what state scotuses typically do

One thing that is CRAZY about Louisiana from the PI perspective is how attys are allowed to front recovery to their clients BEFORE settlement. Its supposed to be for things like basic necessities, rent, transport to and from medical providers, but it translates to a bidding war w PI firms competing to offer nice cars, furnished apartments, etc, to clients during the pendency of the case, if only they'll sign up w one lawyer rather than another.

A. Theft of crawfish is the misappropriation or taking of crawfish belonging to another or proceeds derived from the sale of such crawfish, whether done without the consent of the owner to the misappropriation or taking, or by means of fraudulent conduct, practices, or representations, with the intent to deprive the owner permanently of the crawfish, or proceeds derived from the sale of the crawfish.

B.(1) Whoever commits the crime of theft of crawfish when the misappropriation or taking amounts to a value of five hundred dollars or more shall be imprisoned, with or without hard labor, for not more than ten years or may be fined not more than three thousand dollars, or both.

(2) When the misappropriation or taking amounts to a value of three hundred dollars or more, but less than a value of five hundred dollars, the offender shall be imprisoned, with or without hard labor, for not more than two years or may be fined not more than two thousand dollars, or both.

(3) When the misappropriation or taking amounts to less than a value of three hundred dollars, the offender shall be imprisoned for not more than six months or may be fined not more than five hundred dollars, or both. If the offender in such cases has been convicted of theft of crawfish one or more times previously, upon any subsequent conviction he shall be imprisoned, with or without hard labor, for not more than ten years or may be fined not more than three thousand dollars, or both.

Louisiana law allows "direct actions" against insurers. Following a huge mass tort, the parties negotiated into the wee hours and then the early morning hours before signing the deal.

The defendants and insurers were represented by NYC-based biglaw. The deal got signed around 4:30 am.

Only the Louisiana-based plaintiffs' lawyers noticed that the draft and final release did not cover insurers -- being drafted by NYC biglaw firms who were not used to dealing with direct action jurisdictions.

While the defense team was enjoying breakfast in the hotel restaurant before heading off to bed, the plaintiffs served a second action against the non-released insurers and got another 40% out of the case.

I don't buy that the "gullible" biglaw attorneys were unaware of direct actions against insurers. The much more likely explanation is that the plaintiffs attorneys refused to release the insurers and the insurers agreed to settle the claims against their insureds to avoid massive bad faith claims.

i understand that reaction, but it's what happened. the insurers and their own NYC counsel were part of the settlement negotiations and were at the breakfast table. the "Released Parties" language was treated as boiler plate. It listed the typical dozen or so released parties but did not include the word "insurers."
