This has happened once already, and may happen again. But i need the work.

1. I was brought in to co-counsel a case. Only being given 30% of the net atty fees to do the lion's share (if not more) of prep up to mediation, etc. Upside is that I was brought in two days ago and we'll schedule mediation in 60 days. I'm actually trying to gamify the situation and see if i can completely prep the case for mediation in 15 hours or less - and preferably 10. If so, the equiv hourly rate for my time spent compared to the settlement value will be pretty decent.

2. I'm being asked to do hourly work for a plaintiff's atty to prep a TRO, prelim injunction, etc. He has proposed paying me $200/hr for the work, even though I know that his rates are $450/hr. I'm going to counter with $300/hr for my time. I expect this to take 15-25 hours and it needs to be done in the next 3 days. So I'm probably going to have to accept the best rate he'll give me even if its around 200-225/hr. Upside is that its a quick $5k to $7.5k in my pocket.

How do others deal with shit like this? I'm trying to make smart biz decisions (i.e., accept a less favorable rate/percentage if it means quick cash flow, etc., and I have the capacity).

It's common for contract attorneys to charge/accept a pretty significantly reduced hourly rate if they don't have to deal with billing/collection/marketing/etc. for a matter. Generally, the situation allows for the main attorney on the matter to bill out the contract attorney to the client at a higher rate and make some money on their work. Not sure what your locale or experience is, but I think asking for $300/hr is a bit steep (unless you think the attorney will be billing *your* time out at $450/hr).
