You either detain everyone, even those with kids (who cannot be housed in an adult prison for their own welfare), or you catch and release, knowing that you are de facto allowing in ~40% of illegal entries without any judicial control at all. |

But even at 37% it is the highest demographic of no-shows in the entire federal court system and high enough for rhetorical strength. Are libs willing to return to C&R if they are forced to admit, publicly, that nearly 40% of illegal immigrants can just say "fuck you" and side-step any regulation.
Cons need to frame that debate. If Dems and Laura Bush want only 60% of those "caught" (imagine how many, without a wall, are not caught) to have court oversight, let them own it and let the voters decide. The alternative is to detain everyone, even kids. |
