Not an NY divorcemo but i think your best bet would be to google dissipation of assets in NY to see what the law is on it.

Also, youve provided part of just one provision of the MSA. Maybe there is a credit elsewhere against another asset or for alimony for the dissipation. Also, nondisclosure provisions aren't uncommon.

then like i said it depends entirely on the dissipation law in NY. In NJ for example, you can only claim a credit for dissipation if it occurred at a time when the marriage had already broken down. It's not meant for someone to go back years and years to claim the other party wasted money.

it's also the burden of the party making the claim to prove. So there is the issue of proof and the cost of litigating the claim. IME unless you can show a stretegic liquidation after the parties separated, it's a tough sell in a case that isn't going to trial.
