There is a good full second when the victim steps backwards with his hands up. In that second, the boomer formed the intent to kill, there was no threat anymore because pulling out the gun was sufficient to neutralize the threat.
If the boomer was still standing and the victim was still coming towards him, then the boomer would have no duty to retreat, but the victim was not still coming after him and no reasonable person would feel threatened enough to justify deadly force.

The law does get rid of the duty to retreat, but that is a small part of the law. The law also creates a pre-arrest immunity for anyone who invokes self defense (or the SYG law) which must be disproved at a pre-trial immunity hearing by clear and convincing evidence. The affirmative defense during trial is different, and that is the same as every other state.
Since the trial standard for the affirmative defense of self defense must be disproved beyond a reasonable doubt (in CA or FL) that higher standard should result in the same outcome (theoretically) - SYG simply creates additional procedural burdens to bringing the case in the first place - which probably does have a significant impact on prosecution. |
