Assuming the aggressively approaching the guy on the ground after violently shoving him is enough to create a reasonable fear of serious bodily injury, the interesting legal question will be whether a reasonable shooter has to re-assess the situation in those few seconds between brandishing and firing.
This issue somewhat raised itself in the Goetz case because he kept shooting even after the attackers were wounded on the ground |
