because from the insurer's perspective if they're going to agree to indemnify D, as a condition of that they want to be able to make P carry its burden of proving liability. if both P and D are repped by the same attorney it creates a conflict in that regard. otherwise the process would be completely unfair to the insurer and they would just stop insuring people, or it would require much higher premiums to keep the insurance model profitable

lookup comparative negligence. imagine a dog bite scenario where a neutral factfinder would conclude that P and D are both partially at fault for what occurred (say, 50-50%). so if P suffered $1mm in damages, P would be awarded $500k under a comparative negligence standard. but if both are repped by the same attorney then the attorney would be incentivized to get D to admit to 100% liability. this would be unfair to the insurer. people wouldn't be able to get insured if that was the system we had.
