Have kinda low end apt. that I keep for work in shithole area. I've had it for 4 years. It's cheap I can usually bill it off and then I don't have to stay in hotel or whatever.

Anyway 8 month preggo wife was over here and apt. is on 2nd floor. She was walking down steps outside and concrete step was rusted through around the steel and the concrete was worn and it totally collapsed and broke and she fell through almost Shallow Hal style.

Fortunately it just broke through with her leg falling in and she was able to kind of brace. She called to kids who called a man who was able to pull her out. She was scratched and bruised, but we had to drive all 1.5 hours back to city and check her in and check the baby which was fine we assume by the tests.

Me: inactive JD from another state and I didn't do shitlaw when I practiced. What should I do? And if so, how much should I ask for if I call up apt. insurance and deal with them without really intending to sue?

I think you definitely have something. Need medical records and bills to build case. If she's pregnant she can't have MRIs etc but if she goes to a couple md or chiro visits now she can get it further checked/treated later on.

Don't settle it until after the kid is born and make sure she is 100% ok.

State was New Mexico. We drove her back to hospital in Midland after it happened. She called her OB/GYN (happened yesterday Sunday) and he called her back and told her to go get checked out. We had to go clear her through the ER then check her into the Womens/Infants wing of hospital where they admitted her and did a bunch of tests. Everything seems to be okay, but I am obviously pissed, not to mention literally spent 12 hours of my Sunday dealing with it.

Should I just contact the Apt.'s insurance provider and start a claim and not contact an attorney? This was kind of my thinking, but I don't know what to ask for.

No. Build up the meds before you contact the insurer.

Do you have pictures of the steps? If not go back ASAP and get pictures.

How long ago did this happen?

If the answer to the first question is no and it happened in the last couple of days, she needs to see her GP ASAP complaining of back pain. After the baby is born, she will have an MRI, which may show a bulging disk or two. Bam, you have $100k+ of future meds.

do you have prior notice of the defect? --meaning what will you do if management says they didn't know about the defect until the time your wife fell.

Have you talked to other residents who will say it was messed up for a while beforehand?

JFC, Spaceporn, it is a concrete and steel staircase that failed. Whether or not they had actual notice, a reasonably competent owner of a premises open to the public should have observed the condition of the staircase and appreciated the danger it presented.

You should have photographed the scene or sent someone out to do that. Send a preservation letter and request for their insurance policy, and then have her treat/figure out the medical side and make a demand.
